The petitioner is the subsequent purchaser. Mr.R.Krishnaswamy and Ms.Revathy, the learned counsel oppose the impleading.
2. In the light of the judgment of the Supreme Court in Thomson Press (India) Limited Vs. Nanak Builders and investors private limited and others reported in (2013)5 SCC 397, subsequent purchaser is proper and necessary party to the proceeding. Therefore, this civil miscellaneous petition is allowed.
3. Office is directed to carryout the necessary amendment. It is made clear that the subsequent purchaser cannot exceed the submissions that have been made by the original first defendant.
