The claimant is the appellant filed the appeal challenging the judgment and decree passed in M.C.O.P. No. 694 of 2010 dated 09.01.2013.

The learned counsel for the appellant /claimant brought to the notice of this Court that the appellant /claimant died on 14.01.2017. However, no steps are taken to implead the legal heirs in the appeal for the past about 3 years. 3.

Thus, this Court is able to draw an interference that the legal heirs of the appellant are not interested in pursuing the appeal and therefore, the civil miscellaneous appeal stands dismissed as abated. No costs.
