The petitioners/A1 and A2 in Crime No.233 of 2023, registered by the respondent police for the offences under Sections 406 r/w 420 of IPC r/w Section 34 of IPC, seek bail. The petitioners had been remanded to judicial custody on 18.12.2023.

2.It is stated by the learned counsel for the petitioners that the petitioners had only obtained hand loan from the defacto complainant and therefore, there is no question of any criminal liability on them. However, it is the case of the prosecution that the petitioners had told A1 that he must deposit a sum of Rs.10,000/- to join City Club and then further monies were asked to be deposited failing which it was held out that the earlier deposit will be forfeited. The defacto complainant had thus deposited amounts through G-pay and through bank transfer totally a sum of Rs.5,00,000/-. 1/3

3.The learned counsel for the petitioners stated that the petitioners are very poor but however, they had received the money through G-pay and through bank transfer which can be certainly established. 4.In view of the fact that a substantial amounts had been taken away, I am not inclined to grant bail to the petitioners. Accordingly, this Criminal Original Petition is dismissed. Connected Criminal Miscellaneous Petition is closed. 16.02.2024 ata C.V.KARTHIKEYAN,J.
