The suit for injunction restraining the Town Panchayat from interfering with the peaceful possession of the plaintiff was dismissed by the trial court and the same was confirmed by the first appellate court. Aggrieved by that, the plaintiff has preferred this appeal but failed to pursue the matter further. Hence notice was served to the appellant as directed by this Court to appear and contest the matter if he is interested. However, the appellant has not appeared either in person or through any counsel. However, the learned counsel for the respondent submits that the Town Panchayat has already taken possession of the suit property on 03.03.2005. https://hcservices.ecourts.gov.in/hcservices/
2. In the light of the above fact, the appeal is dismissed for default. No costs.
