This writ petition has been filed for issue of writ of mandamus directing the 2nd respondent to refund the stamp duty and registration fees paid by the petitioner to the tune of Rs.36,200/- on 19.02.2020, since the document that was presented by the petitioner is sought to be taken back.
2.Heard Mr.M.V.Seshachari, learned counsel appearing on behalf of the petitioner and Mr.B.Vijay, learned Additional Government Pleader appearing on behalf of respondents.
3.The document of Memorandum of Deposit of Title Deeds was presented for registration and for that purpose, the petitioner had paid a total sum of Rs.36,200/- towards stamp duty and registration fees. Due to subsequent development, this document is sought to be withdrawn without registering the same. Hence, the petitioner wants a refund of the stamp duty and registration fees paid on 19.02.2020. 4.In the considered view of this Court, since the document itself is now sought to be withdrawn without registering the same, the stamp duty and registration fees paid by the petitioner has to be necessarily refunded to the petitioner. Accordingly, there shall be 2/4
a direction to the 1st respondent to refund the stamp duty and registration fees to the petitioner, within a period of two weeks from the date of receipt of copy of this order. 5.This writ petition is disposed of with the above directions.
