The above petition is filed by the wife seeking transfer of F.C.O.P.No.97 of 2021, filed by the husband for divorce from the file of the Family Court, Erode, to the file of the Family Court, Chennai.
2. The petitioner would submit that she is residing at Chennai and being a lady it would be difficult for her to travel to the Family Court, Erode. The petitioner would also submit that the cause of action for the above petition also vests with the Courts at Chennai, therefore, the transfer may be allowed.
3. The respondent though served has not entered appearance. 4.Admittedly, the petitioner wife is residing at Chennai and the Family Court at Chennai has Jurisdiction to entertain the petition filed by the husband seeking divorce. Therefore, the Transfer Civil Miscellaneous Petition is allowed. https://hcservices.ecourts.gov.in/hcservices/
F.C.O.P.No.97 of 2021 pending on the file of the Family Court, Erode is transferred to the file of the Family Court, Chennai. No costs.
