Respondents Prayer : Writ Petition under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, to consider the petitioners representation dated 17.10.2022 to the respondents and further direct the second respondent to issue individual patta for the petitioners housing plot comprising in Survey No.865, Old Plot No.11, New Plot No.15, Jothi Nagar, Thirumullaivoyal, Chennai District.

ORDER

The prayer sought for herein is for a writ of Mandamus, to direct the respondents to consider the petitioner's representation dated 17.10.2022 and further direct the second respondent to issue individual patta for the petitioner's housing plot comprising in Survey No.865, Old Plot No.11, New Plot No.15, Jothi Nagar, Thirumullaivoyal, Chennai District.

The petitioner purchased his housing plot in Survey No.865, Old Plot No.11, New Plot No.15, Jothi Nagar, Thirumullaivoyal, Chennai District and in order to get patta, the petitioner had given a representation on 17.10.2022 to the second respondent / Tahsildar. In order to consider the said representation and to pass orders, the petitioner has moved the present writ petition with the aforesaid prayer.

3. HeardMr.S.Silambuselvan, learned counsel appearing for the petitioner and Mrs.Akila Rajendran, learned Government Advocate appearing for the respondents.

4. Mrs.Akila Rajendran, learned Government Advocate would submit that the said representation given by the petitioner would be considered by the second respondent / Tahsildar and a decision would be taken thereon within a time frame that may be stipulated by this Court.

5. Considering the said submissions made by the learned Government Advocate appearing for the respondents, this Court is inclined to dispose of this writ petition with the following orders:

That there shall be a direction to the second respondent to consider the representation of the petitioner dated 17.10.2022 and pass orders thereon, on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.

6. With these directions, the writ petition is disposed of. There will be no order as to costs.
