CRL.O.P.No.11454 of 2016 S.VAIDYANATHAN, J.

The petitioner, who was arrested and remanded to judicial custody on 16.04.2016 for an alleged offence punishable under Section 302 of IPC in Crime No.67 of 2016 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that in a drunken mood the petitioner along with other accused are alleged to have assaulted the deceased with hands and pushed him into the water tank and caused his death.

3. The learned counsel for the petitioner submitted that the petitioner has not committed any such offence and he has been falsely implicated in this case. He further submitted that he is in custody from 16.04.2016 and that he may be enlarged on bail.

4. The learned Government Advocate (Crl. Side) vehemently opposed for granting anticipatory bail to the petitioner on the ground that the investigation is pending and chemical analysis report is awaited and if the petitioner is released on bail, he will tamper the witnesses and hinder investigation.

5. Since serious allegations are levelled against the petitioner and considering the stage of investigation, this court is not inclined to grant anticipatory bail to the petitioner and this petition is dismissed. 07.06.2016 vrc CRL.O.P.No.11454 of 2016
