M.Muthuselvam v. P.M.Maruthai Chettiar (Deceased) 1.Mr.M.Sundaram And 5 Others

A.No.1741 of 2023 in T.O.S.No.50 of 2021 R.N.MANJULA,J.

This application has been filed by the plaintiff to implead the proposed respondents 3 to 6 as defendants 4 to 7 as legal heirs of G.Jeevarathinam.

2. But the name of said Jeevarathinam is not found in the cause title of T.O.S.No.50 of 2021. Though it is claimed by the applicant that she was the 4th respondent in O.P.No.906 of 2013, it later got converted into T.O.S.No.50 of 2021. In fact when the O.P. got converted into T.O.S., due to the objections raised by some of the defendants, the said Jeevarathinam remained indifferent and she did not file any caveat. Since this application is filed to implead the LR's of a person who is not a party to T.O.S.No.50 of 2021, this application is unnecessary and accordingly the same is dismissed.
