M/S Vasanta Bhavan Hotels India Private Limited v. Vasantha Bhavan

O.A.Nos.78 & 79 of 2023 in C.S(Comm.Div.)No.23 of 2023 S.SOUNTHAR, J.

The learned counsel for the respondent filed an affidavit dated 01.06.2023, wherein it is averred that even before institution of the present suit, the respondent/defendant had changed the name and style as "Vasantha Vihar".

2. It is further stated in view of the fact that the respondent/defendant had already changed its name as "Vasantha Vihar", the respondent has no objection for grant of interim injunction as prayed in the original applications. The relevant averment in the affidavit filed by the respondent is as follows;

"In the above circumstances, I do not have any objection for grant of the above interim reliefs sought by the applicant before this Hon'ble Court."

3. Recording the said averments made by the respondent in his affidavit dated 01.06.2023, the Original Applications in O.A.Nos.78 & 79 of 2023 are allowed and there shall be an order of injunction as prayed for.
