Respondents Prayer:- Writ Petition filed under Article 226 of the Constitution of India, 1950, praying to issue a Writ of Certiorarified Mandamus, calling for the records relating to the impugned order of the First Respondent in Letter No. 839/No.2/2010-2 dated 04.06.2010 and quash the same and direct the Respondents to re-fix the Petitioner's pay with effect from 01.09.1998 as per G.O. Ms. No. 57, Finance (Pay Cell) Department dated 28.01.1991 by duly adding 5% personal pay and pay arrears of pay and revised pension with all consequential benefits.

O R D E R

(through video conference) Learned Counsel for the Petitioner states that despite intimation sent, the Petitioner has not contacted him and as such, he is not able to conduct the case and he has made an endorsement to that effect in the court record. There does not appear to be any useful purpose being served in keeping the Writ Petition pending indefinitely when the Petitioner is not interested in prosecuting the same.

In view of the same, the Writ Petition is dismissed for non-prosecution. It is made clear that the Petitioner is not precluded from applying for revival of the Writ Petition, if necessary, in accordance with law. No costs.
