Respondents PRAYER : Petition filed Under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, calling for the records pertaining to the order in proceedings in Na.Ka.No.55416/J4/04, dated 05.09.2005 on the file of the Director of Fisheries, Chennai - 6, the 2nd respondent herein, granting permission to the 4th respondent for sale of tax exempted High Speed Diesel and quash the same and to direct the respondents to grant permission to the petitioner's Bunk to sell tax exempted High Speed Diesel.

O R D E R

The learned Counsel appearing for the petitioner submits that the prayer in the Writ Petition has already became infructuous.

2.The license for running diesel bunks are granted on yearly basis. The impugned order dated 05.09.2005 was in force for one year from the date of grant of license, in view of the fact that licenses are granted every year based on the eligibility, the cause arouse for filing of the present Writ Petition becomes vanished. Accordingly, this Writ Petition is dismissed as infructuous. No costs. Consequently, connected Miscellaneous Petition is closed.
