A.No.844 of 2026 in C.S.No.39 of 2025 P.DHANABAL,J., This application has been filed to condone the delay of 214 days in filing the written statement of the applicant/1st defendant in C.S.No.39 of 2025. 2.
The applicant is the 1st defendant in the main suit. After receipt of summons, he engaged a counsel and due to his personal issues, he is unable to follow the hearing of the case for filing written statement. Therefore, there is a delay of 214 days in filing the written statement.
3. The other side has not filed counter affidavit. However, they strongly objected that the reasons stated by the applicant are false and there are no grounds to allow the application.
4. This Court heard both sides and perused the records.
5. Considering the reasons stated in the affidavit and taking into account the facts and circumstances of the case, and in order to give a fair chance to the applicant, and to avoid multiplicity of proceedings and also considering the number of days delay in filing the written statement, this application is allowed and the delay is condoned.
6. The written statement of the 1st defendant is taken on file.
7. Post the main suit on 04.03.2026 for framing of issues. 18.02.2026 nvi
