This Criminal Original Petition has been filed challenging the order passed in Crl.M.P. No.538 of 2018 in S.T.C.No.235 of 2015, dated 05.02.2018 on the file of learned Judicial Magistrate Fast Track at Magisterial level at poonamallee, thereby dismissing the petition filed by the petitioner under Section 311 of Crl.P.C. for recalling P.W.1 for marking of further documents.

2. It is seen that this petition was listed for admission on 12.03.2018. Thereafter, at the request of learned counsel appearing for petitioner, it was adjourned to 26.03.2018. Thereafter, the learned counsel for petitioner did not take any steps to list the matter for admission. Hence, this petition is pending for the past two years even without admitting the above petition. It shows that the petitioner has no interest to pursue this matter further. Therefore, after the period of two years, this court is not inclined to entertain this petition that too it was filed challenging the order passed under Section 311 of https://hcservices.ecourts.gov.in/hcservices/

Crl.P.C. Accordingly, this Criminal Original Petition is dismissed. Consequently, the connected miscellaneous petition is closed.
