Respondents Prayer:- Writ Petition filed under Article 226 of the Constitution of India, 1950, praying to issue a Writ of Certiorarified Mandamus, calling for the records relating to the impugned order in Letter No. A1/2651/2009 dated 19.10.2010 from the file of the Deputy Works Manager, Government Press, Madurai - 625 007, the Second Respondent herein, to quash the same as ultra vires so far as it denies wages due to the Petitioner and to direct the Respondents to expeditiously refix the salary and pension including increments other attendant benefits due and payable to the Petitioner.

O R D E R

(through video conference) The Petitioner challenges the Order No. A1/ 2651/2009 dated 19.10.2010 passed by the Second Respondent in whose office he had worked last before his superannuation from service, and seeks consequential directions for fixing all his salary and pension including increments and other attendant benefits. It is evident that the cause of action for the Writ Petition has arisen within the territorial limits of jurisdiction of the Madurai Bench of this Court where the office of the Second Respondent is located. Respondent is shown to be at Chennai, it cannot be disputed that the said authority exercises his powers in the entire State of Tamil Nadu and insofar as the claim of the Petitioner in this Writ Petition is concerned, nothing material has been shown to have occurred within the territorial limits of jurisdiction of the Principal Seat of this Court.

Having regard to the mandate in Article 226(2) of the Constitution, Learned Counsel for the Petitioner seeks permission of the Court to withdraw the Writ Petition with liberty to file a fresh Writ Petition on the same cause of action before the Madurai Bench of this Court and he has also filed a memo dated 26.11.2021 to that effect through e-mail, which has been placed on record.

In fine, the Writ Petition is dismissed as withdrawn granting such liberty. No costs.
