On representation of the counsel for both sides this case is taken up for settlement before the Lok Adalat. Both the parties are present. Ms.Vinothini, learned counsel for Mr.E.V.Chandru, learned counsel for the petitioner. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows: TERMS OF SETTLEMENT The Criminal Revision Petitioner, Mr.K.M.Tamilselvan and the respondent Subramani are present before the Court. 1/4

2.The Revision arises against the order passed under Section 138 of the Negotiable Instruments Act. The petitioner and the respondent have settled the matter and have entered into an agreement on 22.12.2022, where under, the petitioner has agreed to pay the respondent a sum of Rs.2,00,000/- (Rupees Two Lakhs only).

3.As per the agreement, the petitioner paid the said amount to the respondent.

4.The respondent confirms that he has also received the sum of Rs.2,00,000/- (Rupees Two Lakhs only).

5.The conviction and sentence imposed by the Judgement dated 03.01.2023 made in C.A.No.47 of 2022 on the file of the Hon'ble Court of Sessions Division of the Nilgiris District at Udhagamandalam confirming the conviction and sentence imposed on 04.04.2022 in STC.No.21 of 2016 on the file of the Learned Judicial Magistrate, Fast Track Court at Magisterial level, Coonoor is set aside by virtue of the settlement arrived between the parties. 6.Accordingly, this Criminal Revision Petition is allowed. K.M.Tamilselvan Counsel for the Petitioner Subramani Counsel for the Respondent This Lok Adalat award is passed in terms of the above settlement. The full Court fee paid shall be refunded to the parties in the manner provided under the Court Fees Act, 1870 as provided for under sub Sec.1 of Section 21 r/w 25 of LSA Act, 1987 as amended in 1994. 2/4
