JUDGMENT
Today, when the matter came up for hearing, it is represented by the learned Government Advocate (Crl. Side) that in this case, even though the appellant was charged under Sections 376 and 417 of the Indian Penal Code, he was acquitted for the offence under Sections 376 and for the offence under Section 417 of the Indian Penal Code, he was sentenced to undergo three months Rigorous Imprisonment and imposed a fine of Rs.1,25,000/-.
2. Pending the appeal, the appellant/accused has undergone the entire sentence of three months Rigorous Imprisonment and also paid the fine of Rs.1,25,000/-.
3. The learned Government Advocate (Crl. Side) has also
filed proof for the payment of the fine amount.
4. In that view of the matter, nothing survives in the appeal. Accordingly, this Criminal Appeal is dismissed as having become infructuous. Consequently, Crl.M.P.No.1681 of 2020 is closed.
