M.SATHYANARAYANAN, J., and A.A.NAKKIRAN, J., [Order of the Court was made by M.SATHYANARAYANAN, J., ] Heard the submission of Mr.G.Karthikeyan, learned Standing Counsel (NHAI) appearing for the petitioner and perused the affidavit filed in support of this petition.
2. The primordial submission made by the learned counsel appearing for the petitioner is the lack of cooperation and sensitivity on the part of the parties to be impleaded ,who has also contributes to the delay in compliance of the Six laning project of NH45 and prays for their impleadment, also in public interest.
3. This Court has considered the arguments advanced by the learned counsel appearing for the petitioners as well as perused the affidavit.
4. Having satisfied with the reasons assigned, this miscellaneous petition is ordered and the proposed respondents herein shall be impleaded as respondents 10 to 26 in the main Writ Petition. M/s.King and Patridge accepts notice on behalf of the 10th respondent herein, Mr.R.Vijayakumar, learned Additional Government Pleader accepts notice on behalf of the proposed respondents 10, 11, 15, 16, 17, 18, 19 & 20, Mr.E.Manoharan, learned Special Government Pleader accepts notice on behalf of the 14th respondent, Mr.M.Arockiaraj, learned counsel accepts notice on behalf of the R8 herein / TWAD and M/s.Nithyesh and Vaibhave, accepts notice on behalf of the 21st respondent herein and they seek time to file counter affidavit with supporting documents and photographs.
5. Mr.Vijayan, learned counsel appearing for the 10th respondent would submit that since the bottom Ash is the major requirement for six laning project being undertaken by NHAI, the presence of North Chennai Thermal Power Station is required.
6. Mr.G.Karthikeyan, learned counsel appearing for the petitioners would submit that since the matter is taken in public interest, this Court may suo motu implead them as 27th respondent in the Writ Petition.
7. The North Chennai Thermal Power Station, Attipattu Main Road, Thiruvallur District, Tamil Nadu 600 120, is impleaded as 27th respondent in the Writ Petition. Notice through Court as well as privately to the newly impleaded 27th respondent, returnable on 10.06.2021. The learned counsel appearing for the petitioner is directed to serve papers upon the learned Standing Counsel appearing for the newly impleaded 27th respondent.
Call on 10.06.2021. Interim direction with regard to the collection of toll, is extended till then.
