Prayer Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus to direct the 4th respondent to consider the representation dated 25.10.2024 to grant individual patta in the name of the Petitioners for landed properties situated in S.F.No.297/1B S.F.No. 296/2A and S.F.No. 296/ 3 at Kalapatti west village, Coimbatore Taluk and District.

For Petitioner : Mr.Sam Jayaraj For Respondents : Mr.D.Ravichander Special Government Pleader Order This Writ Petition has been filed by the petitioners seeking for a direction to the fourth respondent to issue individual patta in favour of each of the petitioners for the property (morefully described in the prayer to this Writ Petition) based on their representation dated 25.10.2024 within a time frame to be fixed by this Court.

2. Since acquisition proceedings initiated against the petitioners has been quashed in the year 2007 itself, they seek for issuance of patta in their individual names. However, since, the respondents seek for NOC from the TNHB, which is the beneficiary under the earlier acquisition proceedings, the petitioners are unable to get patta, as seen from the affidavit filed in support of the Writ Petition.

3. The learned Special Government Pleader for respondents would submit that once NOC is issued by TNHB, patta will be issued to the 2/5

petitioners. The said undertaking given by the respondents through the representation made by the learned Special Government appearing for them is recorded.

4. Therefore, this Court deems it fit to direct the fourth respondent to pass final orders on the petitioners' representation dated 25.10.2024 seeking for issuance of individual patta in favour of each of the petitioners for the property (morefully described in the prayer to this Writ Petition) after issuing notice to TNHB and by requesting them to issue NOC and after hearing them within a period of 12 weeks from the date of receipt of a copy of this order. This Court is not expressing any opinion on the merits of the petitioners' representation.

5. With the aforesaid direction, this Writ Petition is disposed of. No Costs. Consequently, connected Miscellaneous Petition is closed. 10.12.2025 sd Index : yes/no 3/5
