..Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorarified Mandamus calling for the records pertaining to the order dated 13.04.2006 passed by the 2nd respondent in Ku.Aa.No.16370/921-1/NiPi2 (2) Ko.O.Na./2006 imposing the petitioner fine of Rs.18,900/- which is equivalent to the monetary value of increment cut for 3 years with cumulative effect, quash the same and consequently direct the respondents to refund him the amount of Rs.18,900/- which was recovered from his terminal benefits together with interest, award costs. Today when the matter is taken up, learned counsel for the petitioner submitted that the sole / writ petitioner died and though they have attempted to contact the legal heirs of the deceased / writ petitioner and also sent communication to them, they are unable to get any instructions and therefore, reported no instructions before this Court.
