Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents herein more particularly the 3rd respondent herein to consider and pass orders on the petitioner's representation dated 14.10.2020 in accordance with law and on merits by taking into account the orders passed by the 1st respondent herein his proceedings G.O.MS.No.8, dated 22.3.2018 and in No.C.983/ H5/Health/2015-16/PF dated 24.10.2018 and further direct the 3rd Respondent herein to return all original certificates relating to MBBS and as well as MS Ortho to the petitioner without insisting excess payment of Rs 72.48 lakhs. ORDER
This writ petition has been filed for the issue of a writ of mandamus directing the 3rd respondent to consider the representation made by the petitioner on 14.10.2020, wherein, the petitioner has sought for returning all the original certificates that were handed over by the petitioner without insisting for any payment.
2.Heard Mr.S.Kasirajan, learned counsel for the petitioner, Mrs.V.Usha, learned Additional Government Counsel (Pondicherry) for the 1st respondent, Mr.V.Balamurugane, learned Government Counsel for the 2nd respondent and Mr.B.Balavijayan, learned counsel appearing on behalf of the 3rd respondent. 3.Taking into consideration the facts and circumstances of the case and also the earlier orders passed by this Court under similar circumstances, there shall be a direction to the 3rd respondent to return back all the original certificates belonging to the petitioner without insisting for payment of any amount. This process shall be completed by the 3rd respondent within a period of one week from the date of receipt of copy of this order. The petitioner shall make a fresh representation along with a copy of this order in person before the 3rd respondent and the 3rd respondent shall act upon the same and comply with the directions issued by this court. 4.This writ petition is disposed of with the above directions. No costs.
