Prayer: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 3rd Respondent conclude the enquiry and dispose of the complaint of the Petitioner dated 25.08.2021 preferred under Section 23(1) of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007.

The petitioner, a senior citizen, prays for a Mandamus directing the respondents, particularly the Revenue Divisional Officer, arrayed as R-3, to dispose her representation filed on 25.08.2021 in terms of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 [hereinafter referred to as 'Act']. https://hcservices.ecourts.gov.in/hcservices/
2. The petitioner has prayed therein for the cancellation of Settlement Deed dated 26.11.2021, executed in favour of her son G.Saravanan arrayed as R-4. The Act mandates, under Section 23
(1) thereof that any complaint filed by a senior citizen be disposed within a period of 90 days from the date of institution thereof. The present complaint has been filed on 25.01.2021 and the statutory period provided for its disposal has expired a long time ago.
3. It is indeed unfortunate that a senior citizen, for whose benefit the Statute has been enacted is the victim of such apathy on the part of the officials of the State.
4. Mr.Vadivelu Deenadayalan, learned Additional Government Pleader, who has oral instructions in the matter, assures the Court that the petitioner as well as R-4 will be heard and application dated 25.08.2021 will be disposed within a period of six (6) weeks from today. This is recorded.
