PRAYER Writ Petition filed under Article 226 of of the Constitution of the India to issue a writ of mandamus directing the first respondent to honour their commitment to provide employment to wards of land donors in terms of G.O.Ms.No.656, Labour and Employment Department, dated 29.06.1983 and grant approval to the proposal of the third respondent, the Registrar, Bharathiar University, Coimbatore, in Letter No.E9/2022/6860 dated 16.5.2022 and regularize the services of the petitioner in the post of Assistant, in the office of the Controller of Examinations, Bharathiar University, from the date of initial appointment in the sanctioned post/vacancy and all consequential benefits accrued from the date of appointment.

ORDER

This writ petition has been filed in the nature of mandamus directing the first respondent to honour their commitment to provide employment to the petitioner in terms of G.O.Ms.No.656, Labour and Employment Department, dated 29.06.1983 and grant approval to the proposal of the third respondent, the Registrar, Bharathiar University, Coimbatore, in Letter No.E9/2022/6860 dated

16.5.2022 and regularize the services of the petitioner in the post of Assistant, in the office of the Controller of Examinations, Bharathiar University, from the date of initial appointment in the sanctioned post/vacancy and grant all consequential benefits which have accrued from the date of appointment. 2.

The lands of the petitioner have been acquired by the Government for establishing Bharathiar University at Coimbatore. The Government at that time issued G.O.Ms.No.656, Labour and Employment Department, dated 29.06.1983, according to which, they had stated that the members of the family whose lands had been acquired for educational purpose will be given priority in employment in public sector undertakings or other statutory corporations. The petitioner claims that though lands had been acquired, she had not been granted permanent employment and her temporary employment had not been regularized. In such circumstances, seeking to regularize her employment, this writ petition has been filed.

Instructions had been obtained on behalf of the first respondent and a letter dated 01.04.2025 has been produced before this court, wherein, it had been stated that the Registrar, Bharathiar University, by letter dated 17.03.2025 had furnished the requisite details of the employees, whose services have to be regularized and it had been further stated that necessary steps have been taken to regularize the petitioner in the post of Assistant from the date of initial appointment.

Let me not enter into any further details relating to the facts, but, issue a direction to the respondents to pass appropriate orders within a period of four weeks from the date of receipt of a copy of this order. The petitioner will be protected by protection of pay and service till orders are passed and even thereafter.
