PRAYER: The Second Appeal has been filed under Section 100 of C.P.C., to set aside the Judgment and Decree dated 21.04.1998 on the file of Additional District Judge, Erode, in A.S.No.173/1997 confirming the decree and Judgment of the court of the Subordinate Judge, Bhavani, made in O.S.No.308/1996 dated 19.02.1997.

J U D G M E N T

Learned counsel appearing for the appellant submitted that in view of the decree of the lower appellate court, no order is required in the second appeal and the same may be confirmed. He has also made an endorsement to that effect.

In view of the above, the order of the lower appellate court is confirmed and accordingly, the second appeal is dismissed. No costs. Consequently, connected miscellaneous petition, if any, is closed.
