Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the second respondent to survey the property of the petitioner bearing survey No.135/1c1, 1H and Patta No.260, measuring about 3 Acres of land situated at Avadathur Village, Mettur Taluk, Salem District, by consider the representation of the petitioner dated 8.02.2021 on the file of 1 to 2 Respondents herein to secure the ends of justice.

ORDER

This Writ Petition is filed for a writ of Mandamus, directing the second respondent to survey the property of the petitioner bearing survey No.135/1c1, 1H and Patta No.260, measuring about 3 Acres of land situated at Avadathur Village, Mettur Taluk, Salem District, by consider the representation of the petitioner dated 8.02.2021 on the file of 1 to 2 Respondents herein to secure the ends of justice.

2.Mr.G.Rajesh, learned Government Advocate entered appearance for the respondents 1 to 6.

3.Since the representation of the petitioner is dated 08.02.2021, which is hardly a month old, this Court does not want to create a situation, where it amounts to discriminate those who are already in the queue.

4.Therefore, this Court directs the second respondent/Tahsildar to hold an enquiry after the conclusion of the General Elections to the Legislative Assembly - 2021, after issuing notice to all the parties who are likely to be affected by his decision, provide them a fair and effective hearing, and dispose of the matter through a speaking order within a period of twelve (12) weeks thereafter.
