This application has been filed for dispensed with from the issuance of statutory notice to 10th and 11th defendant under section 80 of CPC.
2. As per section 80 of CPC, no suit shall be instituted against a Government Official in respect of any act purporting to be done by such Government Official in his official capacity, until the expiration of two months from the date of issuance of statutory notice.
3. This Court by its Order dated 30.11.2021 passed in O.A.No.283 of 2018 etc., batch, has given liberty to the applicants/plaintiffs to file a suit with regard to the subject matter within a period of six weeks from the date of the said order wherein the respondents 10 and 11 herein who are the Government Officials, are not the parties to the said applications. Excepting for the six weeks time granted for filing of the suit, no other reason or 1/3
urgency has been mentioned by the applicants/plaintiffs in this application. Hence, this application is dismissed.
4. Registry is directed to take the suit on file, if it is otherwise in order, after the expiry of the period of two months from the date of service of notice on the respondents 10 & 11.
