This Criminal Appeal filed under Section 378 Code of Criminal Procedure, against the judgment of acquittal of the respondent/accused No.2 wherein she was charged and tried for the offences under Section 406, 419, 420 read with 120-B, 468 and 471 of IPC, whereas she was acquitted by the learned Judicial Magistrate, Alandur in C.C.No.640 of 2005 dated 05.08.2015.

JUDGMENT

This appeal has been filed against the judgment of acquittal of the respondent/accused No.2 passed by the learned Judicial Magistrate, Alandur in C.C.No.640 of 2005, dated 05.08.2015.

2. The learned counsel for the appellant would submit that the appellant/complainant died in the year 2017.

3. The appellant died in the year 2017 itself, so far the legal heirs have not taken any steps to implead them in this appeal to proceed further. Despite giving several opportunities, the learned counsel for the appellant is not interested to argue the appeal. Since the matter is pending from 2015, the appellant died in the year 2017, this Court is not inclined to keep the appeal pending.

4. With the above observations, this Criminal Appeal is dismissed.
