Mr. V.Pandiyan C O M M O N O R D E R Challenging the orders passed in IA.Nos.1 to 3 of 2022 in O.S.No.4393 of 2010 on the file of the II Assistant City Civil Court, Chennai the petitioner / plaintiff is before this Court. The applications have been filed to condone the delay of 1088 days in filing the application to set aside the abatement, to set aside the abatement and to bring on record the 8th defendant as the legal heir of the deceased 3rd defendant, in the suit.

2.The learned counsels have consented that since the only ground on which the applications have been dismissed is on the ground that the legal heir certificate of the 3rd defendant had not been produced and the 3/6

same has now been produced the Civil Revision Petitions may be allowed.

3.Accordingly, the Civil Revision Petitions are allowed. Consequently, the connected miscellaneous petitions are closed. The plaintiff shall file necessary applications for amending the plaint in the light of the legal heirs of the deceased 3rd defendant being brought on record. No costs.
