Learned counsel appearing for the petitioners submitted that there is a deliberate attempt in not receiving the notice. Even the private notices sent were returned without any endorsement.

Considering the above, we are inclined to condone the delay, especially the same is not substantial being only 26 days.

Accordingly, the delay of 26 days in preferring this appeal is condoned and this petition is allowed.
