ORDER

The present application has been filed seeking to permit the third petitioner to execute the Settlement Deed in favour of the first and second petitioners for the schedule property.

2. The case of the petitioners is that as regards to the schedule property to the Judge's summons, this Court had originally granted Letters of Administration in favour of the petitioners in O.P.No.546 of 2023 on 06.03.2024, since, the deceased had died intestate and had found that the petitioners are the legal heirs of the deceased.

3. Presently, the third petitioner had intended to settle the property in favour of the first and second petitioner, therefore, the present application had been filed.

4. I have considered the submissions made by the learned counsel for the applicant and perused the materials available on record.

5. Admittedly, Letters of Administration of the property of the deceased who died intestate had been granted by this Court in favour of the petitioners in O.P.No.546 of 2023 by its order dated 06.03.2024. The present petition had been taken out by the petitioners to permit the third petitioner to execute the Settlement Deed in favour of the first and second petitioners for the schedule property. In view of the claim made by the petitioners, I do not find any impediment in granting the prayer as sought for by the petitioners.

6. In fine, the present application is ordered as prayed for and the third petitioner is permitted to execute the Settlement Deed in favour of the petitioners 1 & 2. 19-02-2025 gba
