This application is filed by the plaintiff to condone the delay of 71 days in filing their reply to the written statement and counter claim filed by the third defendant is allowed for the reason that the third defendant, apart from filing the written statement and counter claim has also taken out application regarding the jurisdiction of this court and maintainability of the suit. Therefore, for completion of the pleadings, the reply sought to be filed by the plaintiff is necessarily to be accepted. Hence, delay is condoned. Accordingly, A.No.3036 of 2020 is allowed.

2.The reply of the third defendant filed in connection with the written statement and counter claim filed by the third defendant is taken on file.
