ORDER : The Court Made the following order :- The petitioner is an absconding accused in Crime No.3204 of 2021 registered for the alleged offences under Section 8(c) r/w 20(b)(ii) (B) of NDPS Act, for which the Anticipatory Bail is sought for now. 2.

According to the First Information Report, the petitioner herein along with other two accused were in trade of ganja. On 05.12.2021, based on the secret information, when the Police team went to the place of occurrence, the petitioner and other accused fled away from the scene of crime. When the premises of the A1 was searched, one accused was arrested along with 1.500 kgs of ganja. 3.

The learned Government Advocate (Crl.Side) appearing for the respondent Police submits that the petitioner is an habitual offender and on seeing the Police team, she fled away from the scene of crime. https://hcservices.ecourts.gov.in/hcservices/

On contrary, the learned counsel for the petitioner would submit that though the petitioner had some bad antecedent, on instructions of the Assistant Commissioner of Police, she wanted to lead a reformed life, but the local police are not inclined to let her to lead a peaceful life and foisted the case. 5.

This Court is not able to take the explanation given by the petitioner herein, while there is a specific averments in the First Information Report and the said First Information Report is subjected to investigation. However, the petitioner herein is not available for investigation.

Considering the nature of offence committed by the petitioner, more so in the light of the bad antecedent of the petitioner, this Court is not inclined to entertain this Anticipatory Bail petition.
