O R D E R

This writ petition has been filed for a mandamus seeking for a direction to the respondent to grant permission for the petitioner to conduct a cultural programme (Adal Padal Nigalchi) in the event of Chinnakesakuppam, Thundukarai Arulmigu Sree Vallimalai Subramaniya Swamy Temple Festival at Katpadi Taluk, Vellore District on 22.02.2021 between 06.00 p.m. and 11.00 p.m. based on the petitioner's representation dated 10.02.2021.

2. Mr.K.Parameshwaran, learned Government Advocate accepts notice on behalf of the respondent. By consent of both parties, this writ petition is taken up for final disposal at the time of admission itself.

3. The petitioner claims that he is a resident in the locality where the aforementioned temple is situated. It is the case of the petitioner that he proposes to conduct a cultural programme during the aforementioned temple festival scheduled to

take place on 22.02.2021. It is also the case of the petitioner that he has given a representation on 10.02.2021 to the respondent seeking permission to conduct the cultural programme on 22.02.2021. According to him, since the said representation has not been considered, the petitioner has filed this writ petition.

4. Heard Mr.A.Sathishkumar, learned counsel for the petitioner and Mr.K.Parameshwaran, learned Government Advocate for the respondent.

5. On instructions, Mr.K.Parameshwaran, learned Government Advocate for the respondent would submit that the residents of the locality where the temple is situated have raised objections and therefore, without hearing them, permission cannot be granted to the petitioner.

6. Admittedly, a representation has been given by the petitioner on 10.02.2021 by the petitioner to the respondent seeking permission to conduct cultural programme during the aforementioned temple festival on 22.02.2021. Admittedly, the said representation has not been considered till date.

7. No prejudice will be caused to the respondent if the petitioner's representation is considered on merits and in accordance with law before the scheduled date of temple festival i.e., on 22.02.2021.

For the foregoing reasons, this Court directs the respondent to consider the petitioner's representation dated 10.02.2021 requesting the respondent to grant permission for conducting the cultural programme in the event of Chinnakesakuppam, Thundukarai Arulmigu Sree Vallimalai Subramaniya Swamy Temple Festival at Katpadi Taluk, Vellore District on 22.02.2021 between 6 p.m. and 11 p.m. and pass final orders on merits and in accordance with law on or before 20.02.2021.

9. With the aforesaid direction, this writ petition is disposed of. No costs.
