Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondents to grant of incentive increment for acquiring the qualification of B.Ed., by considering the petitioner representation dated 27.08.2019.

O R D E R

This writ petition has been filed for issuance of a writ of mandamus directing the respondents to grant incentive increment to the petitioner by considering the representation made by the petitioner on 27.08.2019.

2.The case of the petitioner is that she was appointed as Secondary Grade Teacher in the year 1995 and later she was promoted as a Primary School Head Master in the year 2005 and

subsequently, she was further promoted as Middle School Headmaster in the year 2015. In the meantime, the petitioner qualified by completing the B.Ed., degree in the year 2012. According to the petitioner, she is entitled for an incentive increment for acquiring the B.Ed., degree in accordance with the G.O.Ms.No.107, Education Department, dated 20.01.1976. The petitioner has made a representation in this regard to the respondents on 27.08.2019. Since the same was not considered, the present writ petition has been filed before this Court seeking for appropriate directions.

3.Heard Mr.T.Balachandran, learned counsel appearing on behalf of the petitioner and Mrs.V.Annalakshmi, learned Government Advocate appearing on behalf of the respondents. 4.Taking into consideration the facts and circumstances of the case and also the limited relief that has been sought for in this writ petition, there shall be a direction to the 3rd respondent to consider the representation made by the petitioner on 27.08.2019 and pass appropriate orders in accordance with law, within a period of six weeks from the date of receipt of copy of this order. The petitioner is directed to make a fresh representation to the 1st respondent along with a copy of the representation dated 27.08.2019 and a copy of this order. A copy of the representation shall also be marked to the 1st and 2nd respondent.

5.This writ petition is disposed of with the above directions. No Costs.
