ORDER
This writ petition was filed for the issue of a writ of mandamus directing the respondents to consider the representation made by the petitioner on 29.11.2024, wherein the petitioner has sought for re-determination of compensation. 2.When the matter came up for hearing on 14.02.2025, this Court passed the following order:
Mr.P.Sathish, learned Additional Government Pleader takes notice on behalf of respondents 1 to 4.
2.This Court finds that the petitioner has slept over his right for a very long time and initially he was seeking for a reference under Section 18 of the Land Acquisition Act. Even after the orders were passed by this Court in the year 2007 in the earlier writ petition, it is not known as to whether that order was complied with. The present representation has been made under Section 28A of the Land Acquisition Act and there are no particulars as to whether there was any enhancement of compensation for the adjacent lands which fell within the same acquisition. In short, this writ petition is bereft of details. However, considering the fact that the land has been acquired, this Court wants to ensure that the compensation already 2 / 5
fixed reaches the hands of the petitioner. Hence, the learned Additional Government Pleader shall take written instructions in this regard and place it before this Court.
3.Post this case under the caption 'For Orders' on 14.03.2025 3.When the matter was taken up for hearing today, a status report has been filed by the 4th respondent and the relevant portions are extracted hereunder:

I respectfully submit that in the above circumstances, in compliance with the Order of this Hon'ble Court in WP.No.2308 of 2004 Dated : 11.06.2007, particulars were called on and D-Form under Section 18(1) under the Act was submitted to the Hon'ble Principal Sub Court at Dharmapuri in the year 2010. I submit that the Hon'ble Principal Sub Court at Dharmapuri after the scrutiny of the forms submitted by the Respondents herein, numbered the enhancement compensation case as and the same is pending till date.
9.I humbly submit that Original Petition O.P.No.05 of 2012 is pending sub judice on the file of the Hon'ble Principal Sub Court at Dharmapuri till date and the same is posted on 12.03.2025 for the appearance of the petitioner. I submit that as the respondents herein have already complied with the order of this Hon'ble Court in W.P.No.2308 of 2004 Dated: 11-6-2007, the prayer sought by the petitioner in this writ petition becomes infructuous and the same is liable to be dismissed in-limine.

4.In the light of the above status report, it is left open to the petitioner to workout the remedy in the pending petition before the Principal Sub Court, Dharmapuri, in accordance with law.
