Respondents Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, directing the first respondent to issue suitable directions to the second respondent to take appropriate action in respect of the representation of the petitioner dated 13.12.2017 in respect of the fraudulent sale entry for his property bearing Plot No.170 in 'Sankarapuram Extension' comprised in S.No.34/1, 34/5, 34/6A, 35/1, 35/2A, 36/1 and 41/3B-2 and 99/1, Patta No.591 as per patta in R.S.No.41/64 in the approved layout No.PPD/LO No.4/82, Village No.182, Sithalapakkam Village presently Sholinganallur Taluk, Kancheepuram District.

Mr.Pattabiraman, S/o I.Mangalam claims to be the absolute owner of the property bearing Plot No.170 in Sankarapuram Extension comprised in R.S.No.41/64 as per the approved layout P.P.D./L.O.No.4/82, Village No.182, Sithalapakkam Village, Sholinganallur Taluk, Kancheepuram District measuring an extent of 1890 sq.ft., by virtue of the sale deed dated 26.7.84 registered as Document No.4815 of 1984 on the file of the Sub Registrar, Tambaram. submitted that the petitioner, after purchasing the above property, is permanently staying at Madurai after his retirement from service. Taking advantage of his absence in Sithalapakkam Village, Sholinganallur Taluk, third parties have created some settlement deed in favour of one Mrs.Shanthi on 3.11.2016. Subsequently, he came to know that such settlement deed has been executed. He neither knew Mrs.Shanthi nor signed the settlement deed. After knowing about the fraudulent transaction, he has also given a police complaint and the First Information Report has been registered in Crime No.18 of 2018 dated 15.2.2018 by the Inspector of Police, CCB-II, Chennai. Thereafter, he has also given a representation on 13.12.2017 requesting the first respondent to take action. But till date, no action is taken. Therefore, he has come to this Court.

The learned Special Government Pleader for the respondents submitted that since the First Information Report has already been registered by the Inspector of Police, CCB-II, Chennai in Crime No.18 of 2018, the respondents 1 & 2 will consider the case of the petitioner and take appropriate action in the manner known to law.

3. Recording his statement, this writ petition stands disposed of making it clear that the respondents 1 & 2 shall take appropriate action in the manner known to law, on the basis of the petitioner's representation dated 13.12.2017, within a period of four weeks from the date of receipt of a copy of this order. No costs.
