O R D E R

The instant writ petition is filed to issue a writ of certiorarified Mandamus to call for the records relating to the appointment of 3rd respondent as a Noon meal Organizer in the Panchayat Union Primary School, Neelithoopu, Cuddalore and quash the same and then consequently, appoint the petitioner as a Noon Meal Organiser in the Panchayat Union Primary School, Neelithoopu, Cuddalore.

This Court by an order dated 03.09.2019, directed the learned counsel appearing for the State to produce the relevant files relating to the appointment of 3rd respondent as Noon Meal Organizer in the instant case.

Mrs.K.Bhuvaneswari, learned Additional Government Pleader appearing on behalf of respondents 1 & 2 on instructions would submit that the petitioner was employed in a Government Villupuram Medical College, Villupuram, as Lab Technicial Grade - II and she has been transferred and posted to ESI Dispensary, Nellikuppam, Cuddalore District, by DMO's order dated 16.07.2018 in Neelithoppu village, where the petitioner sought for appointment.

In view of the fact that the petitioner is employed in the ESI Dispensary, Neelithoppu Village, there is no need to examine the issue as to whether the 3rd respondent's appointment as a Noon Meal Organiser is correct or not. The letter sent by the petitioner directly to the 1st respondent clearly shows that the petitioner is not interested in pursuing this case. The said letter is taken on record. 5.

In view of the above, this writ petition is dismissed as infructuous. No costs.
