Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 2nd respondent to conduct an enquiry on the representation/appeal submitted by the petitioner dated 18.12.2019 and the further reminder dated 17.8.2020 pertaining to the unilateral and improper alteration of Patta No.1002, Eraiyur Village, Chengam Taluk, Thiruvannamalai District, standing in the name of the petitioner, by the 3rd respondent and the issue of Patta No.1456 for an extent of 24.70 ares or 61 cents shown to be comprised in sub-division Survey No.134/1A2 in favour of respondents 4 and 5 and pass appropriate orders after giving due opportunity to the petitioner.

ORDER

This Writ Petition is filed for a writ of Mandamus, directing the 2nd respondent to conduct an enquiry on the representation/appeal submitted by the petitioner dated 18.12.2019 and the further reminder dated 17.8.2020 pertaining

to the unilateral and improper alteration of Patta No.1002, Eraiyur Village, Chengam Taluk, Thiruvannamalai District, standing in the name of the petitioner, by the 3rd respondent and the issue of Patta No.1456 for an extent of 24.70 ares or 61 cents shown to be comprised in sub-division Survey No.134/1A2 in favour of respondents 4 and 5 and pass appropriate orders after giving due opportunity to the petitioner.

2.Mr.S.N.Parthasarathi, learned Government Advocate entered appearance for the respondents 1 to 3 and submitted that an enquiry is scheduled to take place on 21.05.2021 at 11.00 a.m at the office of the second respondent.

3.The said statement of the learned Government Advocate is recorded.

4.In view of the above, no further direction is required to be given except that the second respondent is directed to issue notice to all the parties who are likely to be affected by his decision, provide them a fair and effective hearing and to dispose of the matter through a speaking order within a period of twelve (12) weeks after the conclusion of the General Elections to the Legislative Assembly - 2021. 5.The Writ Petition is disposed of accordingly.
