This Writ Petition has been filed seeking to direct the second respondent to initiate proceedings under Section 145 Cr.P.C.
2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondents 1 to 3.
3. After hearing both sides, this Court finds that already civil suit is pending between the parties and it is for the petitioner to approach the civil Court to establish the title of the immovable property.
4. In such view of the matter, this Court is of the opinion that since the entire dispute is civil in nature, the Writ Petition stands dismissed and it is open to the petitioner to establish title before the civil Court. 30.06.2022 ham Index :Yes/No Internet:Yes/No 2/4
