Prayer: Writ Petition is filed under Article 226 of the Constitution of India, for issuance of a writ of Mandamus, directing the first and second respondents to restore the petitioner name in the panel of Horticulture Officer for the promotion to the post of Assistant Director of Horticulture for the year 2001-2002 and to promote the petitioner as Assistant Director of Horticulture with all consequential monetary benefits and to quash the order No.A1/7370/04 dated 09.01.2006 passed by the first respondent in so far as the respondents 3 to 6 are concerned.

The writ petition was listed for hearing on 25.01.2018. None appeared for the writ petitioner. Thus, the case was directed to be listed on 28.01.2019 under the caption "For Dismissal".

2. When the matter is taken up for hearing today i.e., on 29.01.2019, there is no representation on behalf of the writ petitioner. Thus, it is to be construed that the writ petitioner is not interested in pursuing the matter.

3. Accordingly, the writ petition stands dismissed for nonprosecution. However, there shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
