On 01.10.2021, when Application No.3432 of 2021 in C.S.No.282 of 2020 came up for hearing for condonation of 99 days delay in representing the written statement, this Court by mistake, thought that the application is for condoning the delay in filing the written statement and directed the applicant/second defendant to pay costs of Rs.5,000/-. However, while drafting, the error was pointed out and the cost portion was deleted and order condoning the delay was retained. 2.Today the application to condone the delay of 76 days in filing the written statement numbered as A.No.3628 of 2021 is taken up for hearing.

3. Learned counsel for the applicant/second defendant had paid the costs of Rs.5000/- to the plaintiff counsel on 04.10.2021 and proof of payment of costs also filed.
