ORDER

This writ petition is filed for a mandamus directing the respondents to allot a suitable place for establishing an auto stand to park the petitioner's vehicle near the Government Medical College Hospital, Namakkal based on the petitioner's representation dated 22.12.2025.

2. It is the case of the petitioner that he is residing at the above said address and is earning his livelihood by driving a passenger auto. He is the sole breadwinner of his family, which entirely depends on his income from the said occupation. The petitioner is married to one Sivagami, and out of the said wedlock, they have two children, namely Vijayaprasanth and Amrish. The educational expenses of the children are wholly dependent on the petitioner's income. The Namakkal Government Hospital has been functioning for several years, and the petitioner's livelihood substantially depends on transporting patients and 2/5

attendants to and from the said Government Hospital, Namakkal, as well as from nearby places. Similarly, several other auto drivers also depend on trips to the said Government Hospital for their livelihood, and more than 20 families are dependent on such income. In order to establish an Auto Stand near the Namakkal Government College and Hospital, the petitioner submitted a detailed representation dated 22.12.2025 to the respondents. However, no proper response has been received till date. Hence, the petitioner is before this Court.

3. Heard both sides and perused the materials available on record.

4. The petitioner's relief for establishing an auto stand has to be considered only by the Commissioner, Namakkal Corporation and not by the Namakkal Government Medical College Hospital. Admittedly, the petitioner has not made any application to the Commissioner, Namakkal Corporation.

5. Therefore, this writ petition is disposed with a direction to the petitioner to submit a representation to the Commissioner, Namakkal Corporation seeking grant of permission to establish an auto stand near 3/5

the Government Medical College Hospital, Namakkal and upon receipt of the said representation, the Commissioner, Namakkal Corporation shall consider the same and pass appropriate orders on merits and in accordance with law within a period of three weeks from the date of receipt of a copy of the representation.
