Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, calling for the records pertaining to the charge memo issued by the 3rd respondent in their Kurippanai No. Nil dated 31.08.2005 and quash the same and direct the respondents to settle all the retirement benefits to the petitioner by forwarding the pension proposals to the authorities so as to enable them to release the pension and other terminal benefits to the petitioner.

O R D E R

The learned counsel for the writ petitioner states that in respect of the allegations of the year 1993 and 1998, the memorandum of charges were issued against the writ petitioner in proceeding dated 31.08.2005 which was served on the writ petitioner on 29.06.2005. The writ petitioner was allowed to retired from service on 31.08.2005 on attaining the age of superannuation. On account of an enormous delay in framing the https://hcservices.ecourts.gov.in/hcservices/

charges, the charge memo itself is liable to be scrapped.

2. The learned counsel appearing on behalf of the 3rd respondent / School made a submission that, though we have issued the charge memo, the management has not proceeded with the charge memo. This apart, the pensionary benefits and other retirement benefits are settled in favour of the writ petitioner pursuant to the proposals submitted by the School management.

3. This being the factum, the 3rd respondent / School is not interested in pursuing the matter any further. In view of the said submission no adjudication is required in the present writ petition. Accordingly, the writ petition stands closed. No Costs. Consequently connected miscellaneous petiton is closed.
