Respondents Prayer:- Writ Petition filed under Article 226 of the Constitution of India seeking for a Writ of Declaration, declaring Section 69(1) and 69(3) of the Transfer of Property Act as unconstitutional, illegal, violative of Art.14 of the Constitution of India and that the Mortgage Deed executed by the petitioner and her husband in favour of the 2nd respondent as bad in law insofar as it empowers the said respondent to bring the property by public/private auction sale.
