ORDER

This Writ Petition has been filed challenging the proceedings dated 03.07.2007, whereby the provisional Seniority List issued in Notice No.CMWSSB/P&A/STF/RA1/31197/04, dated 27.04.2007 was confirmed by rejecting the objections raised by the petitioner. Though the objections raised by the petitioner for the provisional seniority list was rejected vide impugned proceedings dated 03.07.2007, for the reasons best known that the petitioner has not chosen to question the seniority list, till the year 2011. It is only on 1 st November, 2011, i.e., after a lapse of more than 4 years, the petitioner has come forward to challenge the seniority list that was finalised as early as on 27.04.2007.

2. Absolutely no reasons are stated for the delay of 4 years in challenging

the seniority list. Admittedly, the said seniority list dated 03.07.2007, which was also acted upon for four years and several persons were also promoted from the post of Executive Engineer to the post of Superintending Engineer. Further, none of the persons, who are conferred with seniority over the petitioner are impleaded as parties to the present Writ Petition. In case, if the relief as sought for by the petitioner in this writ petition is granted, several persons will be affected adversely, without putting them on notice.

3. In the light of the above, on the ground of delay and laches as well as on the ground of non-joinder of the necessary parties, this Court is not inclined to entertain the present writ petition and the same is accordingly dismissed.
