O R D E R

This Writ Petition has been filed challenging the impugned ineligible list of candidates after CV for the subject Commerce in No.Nil dated 22.01.2026 issued by the third respondent and the subsequent impugned provisional selection list for the subject Commerce in No.Nil dated 22.01.2026 issued by

the third respondent and to quash the same insofar as not considering the petitioner for selection is concerned and for a consequential direction to the respondents to select and appoint the petitioner to the post of P.G.Assistant (Commerce) under MBC/DNC Category based on merit in the selection, with all consequential benefits.

2. The petitioner applied for the post of PG Assistant [Commerce] pursuant to the Notification issued by the Teachers Recruitment Board. He was called for Certificate Verification. However, on 22.01.2026, the Teachers Recruitment Board released the ineligible list of Candidates after Certificate Verification, in which, the petitioner's name was included in Serial No.3. The reason for such ineligibility was shown as "PG Degree is not equivalent as per G.O.Ms.No.195, dated 14.08.2018".

The fact remains that even during Certificate Verification, the petitioner has submitted G.O.Ms.No.72, Higher Education (K2) Department dated 30.04.2013, in which, in Resolution No.3, it was stated that M.Com Computer Application from Periyar University is equivalent to M.Com Degree. The petitioner also produced G.O.Ms.No.268, Higher Education Department,

dated 29.11.2019, in which, in item No.2.39, it was stated that M.Com C.A offered by Periyar University was equivalent to M.Com for the purpose of employment in Public Services. Therefore, the third respondent failed to take note of the Government Orders produced by the petitioner and delete the name of the petitioner from the list of ineligible candidates and issue an order of selection to the petitioner for the post of PG Assistant in Commerce pursuant to the Notification No.02/2025 dated 10.07.2025.

4. Heard the learned counsel appearing for the petitioner, learned Additional Government Pleader appearing for the respondents 1 and 2 and the learned Additional Advocate General assisted by the learned counsel appearing for the third respondent.

It is fairly submitted by the learned Additional Advocate General that the qualification secured by the petitioner (i.e.,) M.Com in Computer Application from Periyar University is equivalent to M.Com Degree and therefore, the representation of the petitioner will be considered by the respondents and necessary action would be taken in this regard.

Recording the submission made by the learned Additional Advocate General appearing for the respondent No.3, this Writ Petition is allowed and the ineligible list issued by the third respondent dated 22.01.2026 is quashed insofar as Serial No.3, in which, the petitioner's name has been mentioned.

7. The third respondent is directed to act upon the representation submitted by the petitioner taking into consideration of the Government Orders appended thereto and pass suitable orders within a period of two weeks from the date of receipt of a copy of this order.
