J U D G M E N T
This Court, vide order dated 24.04.2023 referred the matter to the mediation appointing Mr.M.K.Kabir, Senior Advocate as the Mediator to resolve the dispute between the parties.

Today, the learned counsel for the appellants as well as the learned counsel for the respondent submitted that the dispute between the parties has been amicably settled and they have entered into a settlement. The Mediator has filed a report, dated 07.09.2023 before this Court, along with the settlement agreement, dated 05.09.2023 signed by both the parties and their respective counsels.
3. In view of the settlement arrived at between the parties, this appeal is disposed of in terms of the settlement agreement, dated 05.09.2023.The settlement agreement shall form part of the decree. In view of the settlement, the E.P. is closed. The party concerned is expected to file a memo mentioning about the full settlement of the claim in order to enable the E.P. to be closed.
4. The parties are entitled to refund of Court fees. At request of the learned counsel for the appellant, the Court fee shall be refunded in the name of the third appellant. Both parties are directed to pay a sum of Rs.1,00,000/- (Rupees one lakh only) each to the Mediator forthwith. No costs. Consequently, connected miscellaneous petition is closed.
