[Respondent]/Respondent Petition filed under Section 482 of the Criminal Procedure Code, to modify the condition of the Principal District and Sessions Judge, Namakkal, in the order made in Crl.M.P.No.77 of 2017 dated 24.01.2017, that "the petitioner shall deposit a sum of Rs.40,000/- (Forty Thousand) as cash security before the concerned Judicial Magistrate Court and the Magistrate shall deposit the same in a Nationalised Bank".

O R D E R

By the impugned order dated 24.01.2017 in Crl.M.P.No.77 of 2017 in Crime No.324 of 2016, the learned Principal Sessions Judge, Namakkal, granted bail to the petitioner on certain conditions. One of the conditions is that the petitioner has to pay cash security amounting to Rs.40,000/- before the concerned Court. Now the present petition has been filed to issue a direction to modify the said condition imposed by the learned Principal Sessions Judge, Namakkal.

2.Mr.C.Emalias, learned Additional Public Prosecutor, takes notice for the respondent.

3.Heard both the sides.

4.Considering the facts and circumstances of the case, the condition imposed by the learned Principal Sessions Judge, https://hcservices.ecourts.gov.in/hcservices/

Namakkal, in the order made in Crl.M.P.No. 77 of 2017 in Crime No.324 of 2016 dated 24.01.2017, in respect of payment of cash security amounting to Rs.40,000/- is modified to the effect that the petitioner shall pay cash security amounting to Rs.15,000/- (Rupees Fifteen Thousand Only), before the concerned Court. Rest of the conditions imposed by the learned Principal Sessions Judge, Namakkal, shall remain unaltered.

5.This petition is ordered accordingly.
