Prayer: Writ Petition filed under Article 226 of the Constitution of India, seeking issuance of writ of mandamus, directing the respondents to step up the petitioner's pay on bar with her junior by complying the Honorable Tamil Nadu Administrative Tribunal in O.A. ORDER
This Writ Petition has been filed seeking issuance of writ of mandamus, directing the respondents to step up the petitioner's pay on bar with her junior by complying the Tamil Nadu Administrative Tribunal in O.A. No.6444 of 2001 dated 17.10.2001 by considering the representation dated 24.07.2025 made by the petitioner and confer all the consequential benefits.
2. With the consent of the learned counsel appearing on either side, this Writ petition is taken up for disposal at the admission stage.
3. The learned counsel appearing for the petitioner would submit that the petitioner's wife initially appointed as Secondary Grade Teacher in the year 1973 and promoted as Tamil Pandit in the year 1980. While so, she was
awarded one increment for acquiring B.Ed., higher qualification and again, she was awarded another one incentive increment for M.A., higher qualification and then she was promoted as Head Master of High School in 2003 and subsequently, retired in the year 2006. However, the petitioner's Junior one Saraswathi appointed as Tamil Pandit by way of Director recruitment and receiving higher pay on bar with the petitioner. Hence, to step up the pay on par with the Junior, the petitioner's wife made a representation on 05.05.2011 and again on 05.03.2021 and no order was passed subsequently, she died in the year 2021. Thereafter, the petitioner made a representation dated 24.07.2025 to step up the pay. Since no was passed, the present writ petition is filed.
4. Heard, the learned counsel appearing for the petitioner as well as the learned counsel appearing for the respondents.
5. The facts of the case is not in dispute. Admittedly, the petitioner's wife entered service in the year 1973 and retired in the year 2006. However, in the year 1982 one Saraswathi, who was junior to the petitioner's wife was appointed and she received higher pay than the petitioner's wife and while the petitioner's was alive, she made a representation in the year 2011 and 2021 however, no order was passed. Subsequently, the petitioner's wife died in the year 2021 and after lapse of 4 years, the petitioner made a representation dated 24.07.2025 seeking to step up the pay, which is not acceptable one.
6. Accordingly, this Writ Petition is dismissed on the ground of delay and laches. No costs.
