PRAYER:Writ petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus directing the first respondent to grant/execute the mining lease for mining of Garnet Sand in favour of the petitioner firm for the areas applied by them in respect of an extent of 24.0 acres, East of SF 273, 274, 275, 276, 277, 293 and 295 and an extent of 40.03 acres, East of SF 298, 62, 63, 86, 87, 88, 93, 94, 95, 239, 240 and 241 in Vembar Village, Vilathikulam Taluk, Tuticorin District.

The learned counsel appearing for the petitioner sought permission of this Court to withdraw this writ petition since the pending this writ petition, the respondents have passed an order and the same has been challenged by the petitioner in W.P. (MD) No.16912 of 2012 before the Madurai Bench. He has also made an endorsement to that effect in the court bundle. 2.In view of the above submission and endorsement made by the learned counsel for the petitioner, this writ petition is dismissed as withdrawn. No costs. Consequently, connected miscellaneous petition is closed.
